This offender died 11/20/2006 Mr.
Adams, Larry
states that once again they put him directly in front of a window that has
cold air coming in around it and he only has 1 blanket..He feels this is
being done to punish him for complaining. He says
that there is a 5 foot long, foot high, pile of trash on the floor across
from his cell and that the cell is filthy and the trash blows in under the
bars and he can't even get cleaning materials from the staff to disinfect
it..and that his affects not only him but all the inmates and states the
other cells are even worse. This is a health hazard.
They
told him he was shipped for respiratory therapy. They have these same
facilities on Wynne Unit.. reason he was sent to Wynne Unit to begin with.
Although the effort is appreciated It would appear
the trip from Wynne to You
state in your letter (see attached) that the Wynne Unit Physician had
advised offender Carter's respiratory problems would exist in any housing
area and there is no indication his condition would improve if moved to a
different housing location. Yes his
respiratory problems would still exist no matter what, but would most likely
would improve if his doctor orders and restrictions from John Sealy were
followed. The
doctor at the hospital When he
got to Beto unit he had to carry all his property...he was denied a cart and
this put him so out of breath that he almost passed out and fell down the
stairs while trying to get to the holding cell.
TDCJ
administration say his restrictions only apply to work? This makes no sense.
The guy is simply requesting a clean warm environment and medical orders /
restrictions be followed. You
know Mr. Adams a lot of the problem I am seeing with medical is simply
because many working within the system do not have any regard for these
people due to the fact they are inmates and view then as sub-human beings
and therefore feel they are not deserving of the same medical treatment
afforded anyone on the outside. The main purpose of prison is to execute the
sentence of the court, i.e. to deprive prisoners of their liberty. However,
it cannot, and must not, be the function of the prison to impose any
additional punishment through poor conditions or arbitrary and ill

many complaints on this unit regarding handicap showers ..no soap, towels or
hot water and filthy living conditions. 3-8-04 . My sister and her husband came to visit me
Saturday here in the infirmary on Beto. She got upset and cried because I
look like a concentration camp victim. The P.A. Buchanan put me back on a
regular diet. I had asked for a hyper Caloric with a snack. I get the snack,
but it is pathetic..2 slices of bread and a wad of peanut butter(which I
can't stand) the size of a quarter in the center. I have been giving it to 2
old men in wheelchairs, who look like skeletons and are so weak they can't
even stand. They need it worse than I do. They are so stingy with the food
here that people are under nourished. Once you get this far down in your
health it is hard to recover. The
infection seems to have ran its course, but I am oxygen dependant still. The
biggest problem I have right now is an old order from November for my
nebulizer treatments. Dr. Love renewed it for 6 months for 1 time a day, but
I have needed it 2-3 times a day and they refuse it. I suffer when I can't
breath and the nebulizer is the only thing that provides limited relief. PA
Buchanan blatantly refuses to even give me the medication that Dr. Love has
ordered, knowing it causes me to suffer. It is no wonder they have COPD
patients die on this unit. I can't
believe the money being wasted on sick, chronically ill inmates by Parole
Board giving set-offs. For example: An old man here just got a set-off. He
was in a program of some kind and he had an f-I-18 (going home on completion
of this program). He was too ill to stay in the program and the doctor put
him in the hospital, so parole revoked the F-I-18 and gave him a serve-all.
This old guy is using a 4 point walker and can barely stand up.
My joy
ride to Esthelle Unit by ambulance was a waste of time. Esthelle refused to
even see me. 3-9-04.. I am suffering because Dr. Love has refused
to see me and has allowed PA Buchanan to continue refusing to provide the
nebulizer treatments with Albuterol and Atrovent that I need to breath.
The
nurse just told me that the once a day order has expired. They have put me
in this infirmary to kill me. Buchanan by refusing me the medication with the
nebulizer treatment will kill me and Dr. Love apparently has decided to let
her. I have begged and pleaded for 2 weeks to see a doctor by 1-60's and
grievance. The
nurse took the nebulizer machine out of my room and said you can use oxygen
to nebulize with. I explained that I do not have the medication and would
need a 02 port to connect to the oxygen outlet. Then she said the order had
expired. I told her I need to see a doctor and get an order I am suffering.
She said maybe tomorrow. The nurse said that Dr. Love had answered my
grievance and no order had been written. He knows I am suffering and a
simple nebulizer therapy would provide relief. I am
debilitated and getting weaker. I am oxygen dependant and without it I get
dizzy if I try to do anything physical, even going to puts me out of breath.
When I can't breath at night the nurses refuse to call the doctor on call.
What do
I do Linda, they have apparently marked me for death. Please get me some
help. Let Dr. Owen Murray know. He can stop this abuse. This is my last
stamp for the next week until I get to commissary. They denied commissary to

suffering every night and the temperatures in the area I am assigned to are
getting even colder. The windows have been covered with thin plastic trash
bags but the plastic will not stay in place and the windows are broke and do
not close enough to seal up the wind. I am
desperate for help and need your assistance before I am so ill I

I have
been moved from the cell block that had plastic trash liners covering 1/2 of
the windows,but now on c1-128b it is worse. They don't even have the trash
liners and it is even colder. I am
not geting my medical needs met. I have written 1-60's to Warden Chance and
when my sister called, he told her I hadn't made a request. I have filed
grievances over a month ago that have not been answered. I don't know what
to do. I suffer every night trying to breath, coughing and wheezing, keeping
my cellmate awake, causing him to get angry. Please help
me. They
recently put in fans in the medical shower..that would be great in the
summer, but they turn them on to torture us, making it even colder than it

He does state he feels the medical Dept Beto is more inclined to help
him than the staff on Wynne unit..but when asked the RN in the
infirmary if they got his discharge orders from

I am concerned about this inmate ..he is
not receiving proper medical care. He states P.A. Buchanan has cut his
medication in half and he has been denied access to imfirmary several times
by a LT. Clark. States he is having abdominal pain and difficulity
breathing. His last visit to infirmary the nurse did nothing for him but
give him a glass of water.. They still have not done the testing that Dr.
Love ordered back in February. Why?

Dear Ms. Hull:
This is in response to your
recent e-mails sent to Executive Director Gary Johnson regarding offender
Carter's living conditions. Your request has been investigated and it has
been confirmed, although there is a problem with a window closing
mechanism in the area where offender Carter was housed, all window panes
in this area were intact as of December 23, 2002. The window mechanism is
pending repair at this time and temporary remedies are in place. As you
know, he was moved to another area and did not feel this resolved his
problem. The Unit Physician has advised offender Carter's respiratory
problems would exist in any housing area and there is no indication his
condition would improve if moved to a different housing location. However,
offender Carter will be transferred to another facility soon and I trust
this will resolve his issues.
Your concern for offenders in TDCJ is

I was shipped to Beto Unit 1/29/03. They told me I was shipped for
respiratory therapy. They have these same facilities on Wynne Unit..the
reason I was sent to Wynne Unit to begin with. They again put me directly in
front of a window that has cold air coming in around it. I only have 1
blanket and the filth, dust and dirt is worse. They obviously sent me here
to get rid of me and punish me for complaining. The Beto Unit is a serious
health hazard There is a 5 foot long foot high pile of trash on the floor
across from my cell. The cell is filthy and I can't get cleaning materials
from the staff to disinfect it. Dust and lint balls roll in under the bars
as well as other bits of trash. I don't want to be moved to another cell as
most others are worse. We should have access to disinfectant provided by the
state, but it is not being provided. I am sending a letter to the Texas
Dept of Health. On this unit the authorities are providing clean clothing
(shirt and pants) On Monday Wednesday and Friday, not every day as other
units. They do allow a shower and clean boxes of socks. We have to wear
degrading clothing. We wear rags that are marked on by the guards across our
chest, showing we have passed through the meal line. The marks accumulate,
by the time we get clean clothing. Sometimes the picket guards will not open
the doors and allow the inmates out for medical shower. . I can see that the
medical Dept here is more inclined to help me than the staff on Wynne unit.
I asked the RN in the infirmary this morning if they got my discharge
orders from John Sealy Hosp. She looked and said no. It would appear the

unit. His medical restrictions were changed on 2/11 as you stated. The
